IMPORTANT: PLEASE READ THESE TERMS OF SERVICE CAREFULLY. BY ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 12) THAT AFFECTS YOUR LEGAL RIGHTS.

1. Acceptance of Terms

By accessing and using Consistent AI (the "Service"), operated by Steadfast OU ("Company," "we," "us," or "our"), a company registered in Estonia (Registry Code: 17132993), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Steadfast OU.

2. Service Description

Consistent AI provides advanced, high-fidelity realistic AI image and video generation tools. The Service is provided "AS IS" and "AS AVAILABLE" for professional creative intent. We reserve the right to modify or discontinue the Service at any time.

3. Eligibility & Age Requirement

You must be at least eighteen (18) years of age to use this Service. By using the Service, you represent and warrant that you have the legal capacity to enter into this binding contract.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. We reserve the right to terminate accounts for violations of these Terms.

5. Ethical Use & Prohibited Content (Zero-Tolerance Policy)

We maintain a Zero-Tolerance Policy regarding illegal activity. You agree NOT to use the Service to generate content that involves:

  • Non-Consensual Intimate Imagery (NCII): Unauthorized likenesses or "deepfakes" of real individuals.

  • Illegal Material: Content involving minors (CSAM), terrorism, or extreme violence.

  • Intellectual Property Infringement: Intentional violation of third-party rights.

  • Deceptive Content: Material intended to defraud or mislead. ⚠️ VIOLATIONS WILL RESULT IN IMMEDIATE ACCOUNT TERMINATION WITHOUT REFUND AND MAY BE REPORTED TO LAW ENFORCEMENT.

6. Intellectual Property

  • Your Content: You retain ownership of the original prompts you create.

  • Generated Output: Subject to compliance with these Terms, you are granted full commercial and personal rights to the AI-generated output. You are solely responsible for the final use of these assets.

  • Privacy-First: We do not use your private generations or prompts to train our public AI models.

7. Billing, Credits & Refunds

  • Payment: All payments are processed securely through Stripe.

  • Credits: Credit balances are non-transferable and expire 100 days after a subscription lapses.

  • Refunds: Due to immediate and significant GPU computational costs, all sales are final.

  • EU/UK Customers: By initiating a generation request, you expressly consent to immediate performance of the digital service and acknowledge that you waive your 14-day statutory withdrawal right under the Consumer Rights Directive 2011/83/EU.

8. DMCA & Copyright Policy

We respect intellectual property rights. If you believe your work has been infringed, please reach out via our official support channels provided on the platform.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" BASIS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. AI OUTPUTS ARE PROBABILISTIC AND MAY NOT MEET YOUR EXPECTATIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STEADFAST OU SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID IN THE PRECEDING 12 MONTHS, OR (B) $100 USD.

11. Indemnification

You agree to indemnify and hold harmless Steadfast OU and its affiliates from any claims arising from your use of the Service or violation of these Terms.

12. Binding Arbitration & Class Action Waiver

PLEASE READ THIS CAREFULLY.

  • Agreement to Arbitrate: Any dispute arising from these Terms will be resolved exclusively through final and binding arbitration (JAMS Streamlined Rules), rather than in court.

  • Rules: The seat of arbitration shall be Delaware, United States (or another mutually agreed location).

  • Class Action Waiver: YOU AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS ACTION.

13. Governing Law

These Terms and any Dispute shall be governed by the laws of the Republic of Estonia, without regard to conflict of law provisions.

14. Termination

We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.
